LML Sues Bajaj Auto For Trademark Violation Over Iconic 'Freedom' Brand

SG Corporate Mobility, the parent company of LML brand, has filed a lawsuit against Bajaj Auto before the Delhi High Court, accusing the latter of unauthorised use of the trademark 'Freedom' for their recently launched Bajaj Freedom CNG motorbikes.

According to a communication from LML, this dispute centres around the ownership of the 'Freedom' brand, which was first introduced by LML in 2002 with the launch of their LML Freedom motorcycles—a massive success in the Indian market, widely recognised for their durability, style, and strong performance.

In 2021, LML assigned the trademark 'Freedom' along with the 'LML' trademark to SG Corporate Mobility, including all associated goodwill and reputation. SG Corporate Mobility is now actively working towards relaunching new scooters and motorcycles under these well-established labels through its sister concern, LML Emotion.

The lawsuit emphasises SG Corporate Mobility’s determination to protect its intellectual property rights, asserting that Bajaj Auto's use of the 'Freedom' trademark on its motorcycles infringes upon its statutory trademark rights and dilutes the reputation built around the original LML Freedom bikes. SG Corporate Mobility has ambitious plans to reclaim and expand upon the legacy of the LML brand by introducing a new line of scooters and motorcycles, including electric models, under the 'Freedom' label, the communication said.

SG Corporate Mobility has also entered into strategic collaborations, such as partnering with Saera Electric Auto to use its manufacturing facility in Bawal, Haryana, previously used for Harley Davidson bikes, to produce these new models. The company's legal representation in the ongoing case is led by the law firm Anand and Anand, with Advocates Pravin Anand, Jaya Negi, and Yashi Agrawal handling the case. The lawsuit remains pending before the Delhi High Court.
